YOUR INFORMATION. YOUR RIGHTS. OUR RESPONSIBILITIES.

This Notice of Privacy Practices describes how Attentive Space, LLC may use and disclose your protected health information (PHI), how you can access your health information, and your rights regarding your health information.

Please review this notice carefully.

This Notice applies to psychotherapy and other mental health services provided by Attentive Space, LLC, including individual psychotherapy, couples therapy, sex therapy, family therapy, and concierge psychotherapy services.

This Notice does not apply to coaching or mediation services provided by Attentive Space, LLC. Coaching and mediation are separate services and are not provided as psychotherapy or other health care services.

Attentive Space, LLC is committed to protecting the privacy of your health information and complying with applicable federal and Virginia privacy laws.


YOUR RIGHTS

When it comes to your health information, you have certain rights. You may:

Get a copy of your health record

You have the right to inspect and obtain a copy of your health information maintained by Attentive Space, LLC, subject to applicable federal and Virginia law.

You may request your records in a paper or electronic format. We may charge a reasonable, cost-based fee when permitted by law.

Ask us to correct your health record

You may ask us to correct health information that you believe is incorrect or incomplete. Your request must be made in writing and explain why you believe the information should be corrected.

We may deny your request in certain circumstances permitted by law. If we deny your request, you have the right to submit a written statement of disagreement.

Request confidential communications

You may ask us to contact you in a particular way or at a particular location—for example, by telephone at a specific number, by email, or by mail at a particular address.

We will consider reasonable requests and will not require you to explain the reason for your request.

Ask us to limit what we use or share

You may ask us to limit the health information we use or disclose for treatment, payment, or health care operations, or that we share with someone involved in your care or payment for your care.

We are not required to agree to every request.

However, if you pay for a health care service completely out of pocket and in full, you may request that we not disclose information about that service to your health plan for purposes of payment or health care operations, and we will honor that request unless disclosure is required by law.

Get a list of certain disclosures

You have the right to request an accounting of certain disclosures of your health information made by us during the six years preceding your request.

The accounting does not include certain disclosures, including disclosures for treatment, payment, health care operations, disclosures you authorized, and other disclosures excluded by law.

Get a copy of this notice

You may request a paper copy of this Notice of Privacy Practices at any time, even if you have agreed to receive it electronically.

Choose someone to act for you

If you have given someone medical power of attorney or if someone is your legal guardian, that person may exercise your rights and make choices about your health information on your behalf, as permitted by law.

We will verify that the person has the appropriate legal authority before acting on their request.

File a complaint

If you believe your privacy rights have been violated, you may file a complaint with Attentive Space, LLC or with the U.S. Department of Health and Human Services Office for Civil Rights.

You will not be retaliated against for filing a complaint.


HOW WE MAY USE AND DISCLOSE YOUR HEALTH INFORMATION

We may use or disclose your health information without your written authorization when permitted or required by law.

The following are examples of permitted uses and disclosures.

Treatment

We may use or disclose your health information to provide, coordinate, or manage your mental health treatment.

For example, with an appropriate authorization when required, we may communicate with another health care provider involved in your care.

Payment

We may use and disclose your health information to obtain payment for services we provide.

Attentive Space, LLC is a cash-pay, out-of-network practice. We do not submit insurance claims on your behalf.

We may provide you with a superbill or other documentation that you may submit to your insurance company for possible out-of-network reimbursement.

We use SimplePractice and Stripe to process payments and perform related administrative functions.

Health care operations

We may use and disclose your health information as necessary to operate our practice and provide services.

These activities may include quality assessment, business administration, compliance activities, and other activities permitted by law.

Business associates

We may disclose health information to companies or individuals who perform services for Attentive Space, LLC that involve the use or disclosure of protected health information.

These parties are required to appropriately safeguard your information and, where required by HIPAA, enter into business associate agreements with us.

For example, Attentive Space, LLC uses SimplePractice for electronic health records, client communications, telehealth, and related practice-management functions.

When required by law

We may use or disclose your health information when federal, state, or local law requires us to do so.

To prevent serious harm

We may disclose health information when necessary to prevent or lessen a serious and imminent threat to the health or safety of you or another person.

Virginia law also establishes circumstances in which mental health providers have duties to take precautions to protect identifiable third parties from certain serious threats.

Abuse or neglect

We may disclose information when required or permitted by law to report suspected abuse, neglect, or exploitation of a child or vulnerable adult.

Judicial and administrative proceedings

We may disclose health information in response to a court or administrative order and in other circumstances involving legal proceedings when permitted or required by law.

Law enforcement

We may disclose health information to law enforcement when permitted or required by applicable law.

Public health and other legally permitted purposes

We may disclose health information for public health activities and other purposes permitted or required by federal or Virginia law.


USES AND DISCLOSURES THAT REQUIRE YOUR AUTHORIZATION

For uses or disclosures not described in this Notice or otherwise permitted or required by law, we will obtain your written authorization.

You may revoke an authorization in writing at any time, except to the extent that we have already relied upon the authorization.

Marketing

We will not use or disclose your protected health information for marketing purposes without your written authorization when such authorization is required by law.

Attentive Space, LLC does not sell or rent client information.

Sale of health information

We will not sell your protected health information without your written authorization when authorization is required by law.

Psychotherapy notes

Most uses and disclosures of psychotherapy notes require your written authorization.

Psychotherapy notes receive special protection under HIPAA and applicable Virginia law. Virginia regulations generally require authorization for disclosure of psychotherapy notes, subject to specific legal exceptions.


COMMUNICATIONS WITH YOU

Attentive Space, LLC may communicate with you by telephone, email, text message, and through the SimplePractice client portal.

Email and text messaging are primarily used for scheduling and administrative communication.

Because ordinary email and text messaging may involve risks outside of our control, you should use the SimplePractice secure client portal when communicating sensitive clinical information whenever possible.

You may request that we communicate with you by a particular method or at a particular location, as described above under Your Rights.


COUPLES THERAPY AND PRIVACY

When Attentive Space, LLC provides couples therapy, each person in the couple is an individual client and signs their own informed consent for treatment.

Because couples therapy involves more than one client, privacy and confidentiality may be handled differently from individual therapy.

At the beginning of couples therapy, the couple and therapist will discuss how information shared individually with the therapist will be handled. Depending upon the couple’s preference and the agreement established for their treatment, the therapist may maintain certain information shared individually as confidential, or may share information between the partners.

The confidentiality arrangement selected by the couple is part of the couple’s informed consent for treatment.

If information needs to be disclosed to an outside health care provider or other third party on behalf of one or both partners, each individual will generally need to complete an appropriate authorization for disclosure when required by law.

This Notice does not replace the couples informed-consent agreement, which provides additional information about confidentiality in couples therapy.


CONCIERGE PSYCHOTHERAPY

Attentive Space, LLC may provide psychotherapy outside the office when clinically appropriate and agreed upon with the client.

Examples may include meeting a client at another agreed-upon location.

The same confidentiality and privacy protections apply to psychotherapy provided outside the office, subject to the practical limitations and privacy risks associated with the location in which services are provided.


YOUR HEALTH INFORMATION AND YOUR INSURANCE COMPANY

Attentive Space, LLC does not participate directly with health insurance plans and does not submit insurance claims on behalf of clients.

If you request a superbill or other documentation for possible out-of-network reimbursement, the information contained in that documentation may be shared with your insurance company by you.

If you pay for a health care service entirely out of pocket and in full, you may request that we not disclose information concerning that service to your health plan for payment or health care operations, except where disclosure is required by law.


SUBSTANCE USE DISORDER RECORDS

Attentive Space, LLC does not provide substance use disorder treatment and does not operate a federally assisted substance use disorder treatment program.

Attentive Space, LLC does not create or maintain records as a federally assisted substance use disorder treatment program under 42 CFR Part 2.

If Attentive Space, LLC receives or maintains records that are subject to the federal confidentiality protections applicable to substance use disorder patient records, those records will be handled in accordance with applicable federal law.

The federal requirements governing substance use disorder records were updated effective February 16, 2026.


OUR RESPONSIBILITIES

Attentive Space, LLC is required by law to:

  • Maintain the privacy and security of your protected health information.
  • Provide you with this Notice describing our legal duties and privacy practices.
  • Follow the terms of the Notice currently in effect.
  • Notify you as required by law if a breach occurs that compromises the privacy or security of your protected health information.
  • Provide you with a copy of this Notice upon request.
  • Comply with applicable federal and Virginia laws governing the privacy and confidentiality of your health information.

We will not use or disclose your health information other than as described in this Notice or as otherwise permitted or required by law.


CHANGES TO THIS NOTICE

Attentive Space, LLC reserves the right to change the terms of this Notice and to make the revised Notice applicable to all protected health information we maintain.

If this Notice is materially changed, the revised Notice will be made available upon request and will be posted on the Attentive Space, LLC website.
